One more note: I just started digging into the opinion and it’s worded in a way that it could easily be applied to cases of gender identity based discrimination. It effectively undoes the decision in Ulane, which is what arguments that Title VII does not afford trans plaintiffs protection rely on.
The court can only rule on the case in front of them, and the appellant in this case is cisgender.
I haven’t read through the opinion yet but just from scanning through it, it looks like Posner’s concurring opinion is....Posner-y. He describes LGBT folks as “normal in all the ways that count”.
