The study was peer-reviewed, and attempted to control for age. It has failings, sure, but I would argue that they are no greater than the one study you’ve posted.
Except that study didn’t study athletes, and didn’t directly study athleticism. This study did look into race times among transgender athletes (Although not at an elite level) and found no competitive advantage for trans athletes.
Per this study, “there is no direct or consistent research suggesting transgender female individuals (or male individuals) have an athletic advantage at any stage of their transition”.

A fair proposal would be to not legislate this issue because it doesn’t need to be.
Schools can decide on their own rules, with parent input. But honestly, when the kids are pre-pubescent, it shouldn’t matter; the biological differences are not that pronounced until then.
