Uh, I think you missed the part where Picard DID know the kid had the right to make the choice. That's exactly WHY he was trying so hard to convince the kid to decide to stick with humanity. Picard's realization wasn't about letting the kid make the choice, it was about accepting that he couldn't CHANGE that choice.
