Ubisoft pulled Wii U exclusivity from Rayman Legends for a reason. I wouldn't use Ubisoft as a glowing example of Wii U support. It appears that, despite the huge short-term bump they got from the Wii, Nintendo's decades long declining trend will continue.

No worries. Remember that the vast majority of suits settle out of court - we're talking between 90-97% of them. A judgment against the publisher could expose them to a large liability - it's cheaper for them to pay the creators and their attorneys than it would be to give them royalties on each copy of the game…
