I am no lawyer or anything, but I think people are unlikely to sue under the state of Texas law if it means a countersuit from the full DOJ  for violating FACE.  Not sure what penalties FACE could offer, maybe you could research that before throwing stones? Might make a nice little blog.  

HIPAA only applies to medical providers who collect medical information in a system of records.
