The only people afraid of diversity are those who want to reduce the pool of potential competitors so that their work isn’t compared to someone potentially more competent than they.

Fair use is pretty straightforward: She’s using the photos for commentary and criticism.

What she is doing is straight up fair use - even if she makes money. It’s review/criticism and parody.

Out of curiosity (and fair use questions aside), why do Zillow’s TOU matter at all? They aren’t laws. They are just “terms”. If she had an account on Zillow, I’d say they are perfectly within their rights to terminate her account. They are perfectly within their right to refuse to let her list houses on the site or

I had not, and likely would not have ever heard about this womans blog had Zillow not sued her. The bad press Zillow is going to get over this is far greater than the minimal inconvenience this causes them.

She might well qualify under criticism since she is obviously criticizing and commenting on the photos and their subjects (from a casual but still academic standpoint, no less). I seriously doubt anyone proposing fair use is suggesting that because the site “doesn’t make money,” since it very clearly does.

I am sending her money. McMansion Hell always raises my spirits when I feel down, because at least I do not live in a tacky, obscene, energy-hogging Hellhole. Which has no topsoil. And which is slowly but surely stealing my soul every day I live there.

The really damning evidence for me is that a supplier actually called waymo and was like “someone is asking us to build a part that looks like yours”.

Zach Snyder used to be music video director. And it shows. His trailers are always great, as are his music-video-like opening credits. But when you ask him to make a feature lenght movie, he isn’t so great. But give him 5 minutes and a song, and he’ll knock it out of the park.

Exactly. The trailers all look great, and then you realize that the movie itself is that trailer, but 3 hours long.

The Zack Snyder brand is awesome trailers, shitty movies. Sucker punch anyone?
