Those emails....

ICE requires a warrant or a reasonable belief that she was in violation of immigration laws AND a reasonable belief that she would escape before a warrant were obtained in order to arrest someone.

me: This law is dumb.

The real end to that sentence is “...but if they’re mostly harassing brown people it’s cool.”

It’s sort of a fact of life that you get used to around here, and I can almost guarantee you that all the New Mexicans in the line behind her were rolling their eyes and laughing at her for making a scene and holding up the line.

And there’s no emergency here.

Umm no. You can’t be detained for 24 hours without cause. Authorities can hold a person for 24-48 hours in the case of an emergency.

Citizens do not have to carry documentation for these checkpoints, but others do. That’s covered by subsection e.

No. Evidently, all you have to do is say “I’m an American citizen”.

I am not at all certain that is possible...and even less probable by a “newly-minted” agent.

These days, I totally agree with you dogrivergrad68! However, to my (rather limited) knowledge it has not been a specific requirement within the borders of the United States to carry “citizenship” paperwork on a person’s person (at all times).

Jokes on them. I don’t even know where my birth certificate is.

I lived in the states for a while, I woulda been sunk.

That’s a lot of words to basically write “It’s okay for the government to ask you for your papers”.

FYI, as a documented immigrant, no we do not carry our paperwork everywhere we go. The commenter you are responding to doesn’t have the vaguest idea what he is going on about which is par for the course for him

It’s not about proving. It’s about intimidation and given them the opportunity to come up with probable cause.

“Look, I hate the CBP as much as the next guy.”

Not getting that impression, actually.

I’ve seen the dogs there frequently, but you’re right. Who they do decide to detain and ask for papers can be pretty racist though. I’ve (white lady) never had to produce any - I have to produce more when I’m rolling through Los Alamos Labs than I do at the checkpoint - but my husband and my other Native and Hispanic

Thank you CMOP, I was not aware that documented immigrants would necessarily carry their own personal immigration (status) paperwork with them at all times when traveling within the United States.

Exactly, no one drives around with all that shit.
