Some people say that he does not know how to read. Just like some people say that he is not releasing his taxes due to how much he donates to NAMBLA.

It’s not strictly legal to do what he was doing. As I said, the government had not thought of the idea of using partnership equity to hide the income from getting ones debt forgiven. Therefore, that part was not illegal yet. He was hiding income from debt though, which is illegal.

Basically, he did something that was not strictly illegal at the time, because no one had thought of it as a way to write off tax debt. He basically said to his creditors that if they forgave his debts to them, they could have a bit of stock in his company. Technically, this would be considered taxable income again.

It’s not a loophole. If he had been audited, he would have had to pay tax on those forgiven loans. Unfortunately, Congress doesn’t fund the IRS well enough, so they do not have enough auditors to find instances of tax fraud and evasion.
