An Executive Order is solely through Presidential powers, and has three limitations: it has to be temporary, it has to abide by already existing laws (meaning an EO can’t be creating a brand new law), and it has to be deemed Constitutional. In a nutshell, the ability to challenge unconstitutional or unlawful acts by the Federal Government is one of the judiciary’s most important powers.
