What you quoted literally says the opposite of what you claim. You give instagram a license to publish it, but nothing else changes. The ownership stays the same as before. It’s right there in the text.
I mean, that’s not what the ToS says. It only says that Insta gets a broad license to use your photos, not that they own them or that anybody else can use them (unless Insta grants them permission to—it’s a transferable license). It’s still a rights grab for sure, but it’s not the same as saying that you no longer own…
