You answered the question yourself: If MacIntyre then told someone else what she told him, then THAT’s hearsay. MacIntyre was never a witness to any wrongdoing. He told her to report the accusation to the police (and he reported her accusations to his superiors), which is exactly what he should have done.
In my opinion, asking a man who was hired to coach football to also be detective, prosecutor, judge and jury isn’t such a great idea. Especially if that coach has a vested interest in the outcome. MacIntyre asked the victim to report the abuse to the police, which she eventually did. That is how things should work,…
If the victim had gone straight to the police you would be correct. She would be a live witness. But the point is she didn’t, she went to the coach - who was not a witness, and therefore anything he would have told to the police would be the textbook definition of hearsay. It’s not a difficult concept.
Let me help you:
If I call the police right now and tell them FritzKekich assaulted me they will not arrest you without corroborating evidence.
Penn State covered up direct knowledge of a crime. That didn’t happen here, so to compare this to the Sandusky case is disingenuous or ignorant of the facts, you decide.
A) They are a public institution - not relevant, public institutions are beholden to the law and aggrieved employees fired by a public institution can seek redress in court.
Suspension of an employee due to hearsay (and hearsay alone) is a great strategy to pay that employee a lot of money in a settlement for wrongful termination or defamation of character. If there is police/court action against the employee, then the employer has grounds to act. That’s proper CYA. There is nothing…
The accuser did not go to the police (or speak to SI for that matter) until well after she spoke with CU. DiStefano and MacIntyre had nothing to act on other than her word against his. You are saying that MacIntyre had the obligation to inform law enforcement using the the textbook definition of hearsay. Now think how…
I made the same mistake!
Emma - question for you: if a woman were to call your office tomorrow and inform you that one of your male co-workers had abused them for the past three years, but without any specific proof, without any specific suspicion, and without any police records - should that co-worker be fired on the spot? Is this an…

I think you are correct but I’ve been left wondering if it may be closer than we expect due to this observation: I live in uber-liberal boulder, colorado and I have seen very few hillary-kaine bumper stickers. obama-biden stickers from ‘08 are more prevalent (standard issue on every prius) if boulder residents aren’t…
it was 2-0, then 2-1, then 3-1, then 3-2. by “come back” he means making the game interesting. as a Arsenal fan I was assuming there would be late defensive error and the game would end a draw
