I also have an 01 e39 M5 with 170klms on it. Aside from servicing, it does ask me to find at least one fault per year. I don't really mind though, as I love it, and I enjoy spending money on it. I have factored maintenance and replacement parts into my ownership of it, including a vanos rebuild.
I've read a bit about the torque converter being part of the issue, and that it ends up being the replacement part. Can be attributed to low fluid levels and a packed filter. Next thing in going to do is the tailshaft coupling (guilbo joint?) and then check what version of gearbox software I have.
