This isn’t a new business model. BMW and Mercedes have done it this way for years and you’re still able to negotiate.

Order any bespoke BMW/Mercedes and it’s ordered directly from the factory and shipped to you. Family has ordered a 7-series this way once in the colour and spec they wanted. Took about a month…

That is sort of a moot argument as NHTSA doesn’t test all vehicles within a company, hell they have massive gaps in entire company lineups. Right now a company like Volvo has a complete 5 star rating... for the cars that NHTSA tested, but cars like the V90 weren’t tested.
