I think it's clear that they are gaming the system to favor less emissions over the lifetime of ownership, something electrics clearly due better in CA (in Coal powered states, probably not so much). If it was just mpg, yeah, diesels can rank up there with the best of the hybrids.
Pro-tip: Own more than one car. I own cars that get 9, 24, and 41 mpg. I'd probably trade in the 41 mpg car for an electric lease.
Setting the alarm earlier hits me in quality of life, and moving closer to work is crazy given the cost of housing and the average duration of employment at any one employer.

Yeah, my commute is nowhere near as bad as yours, but my one-way is 19.2 and a 50 min drive.

Where do you live where they are empty during rush hour? In the Bay Area they doing well when they're getting +15 mph faster than the regular lanes.
I own 1st gen Prius that is now only getting 41 MPG. It is a crappy econobox of a car, but it does what it says on the box in traditional Toyota fashion.
I see 20+ Tesla every day with the sticker. (As they cruise past me in the HOV lane.) The ones without the sticker are actually the minority. They get the white/pure electric sticker too which is much easier to get than the green one (electric-hybrid that they ran out of per the article).
Diesel's don't get the sticker. For many of the folks that I see on my Silicon Valley commute every morning, gas mileage isn't the concern ... the HOV lane is.
It would shave 15 min off my commute, each way, for a +30 min of my life I get back every day. There is value to that.
