No, the fabrication was the incidences that took place AFTER her arrest, with the daughter. You’re conveniently leaving out the fact that she had 3 warrants and refused to cooperate with police after her arrest.

It doesn’t even matter because assault laws by default aren’t cut and dry, and the officer stated as much based on past incidences. Many times esp. in custody battles, assault claims are made to gain favorability by a judge and yet thereisn’t actual evidence of the alleged assault taking place. So what usually

Neither I nor the officer are defending his actions...AT ALL. I stated this never even happens if not for him littering, and the mother questioning if it even did (raisins on ground and still with child). You are implying that a guy painting his fence that knows the family lives a few houses down, just randomly

Civilian assault and assault on police are entirely different per the voted on laws in our country dumbass. People can fistfight all day and see no charges, you fight with a cop and the laws are different and you know this.

Ditto...fuck off.

Fuck off.

Yup...fuck off.

Fuck off.

Keep fucking off.

Fuck off.

Fuck off idiot. Right, the guy busy painting that never had ANY other interactions with this neighbor suddenly and randomly assaults a kid for no reason, despite him actually having the items he threw on the ground still on him!!

This:

He was painting and saw him throwing them on the ground, assuming it was crumpled paper I guess.

It helps in a court of law, hence why victims and doctors are always sure to take pictures as “evidence”. If we argue and you call the police stating I battered you, the very first thing the police will do is look for markings.

Consent has no bearing, you are implying that he would need to come over and ask permission to grab her child. The act is the only thing in question here, and being a parent doesn’t provide leeway from the law with regards to assault. Perfect example: Brad Pitt grabbed his child, Jolie filed assault/abuse claims.

Nope, even in Texas, if the neighbor witnessed the mother doing the exact same thing to the child, police will investigate and contact Social Services to determine whether or not assault charges should be filed.

Wrong, assault doesn’t recognize whether or not you are related, hence why we have Social Services.

I posted a link which offered multiple EXAMPLES!! Secondly, there is no default standard when applying assault, hence why people get let go ALL OF THE TIME!! Third, he wasn’t a stranger, she KNEW him as a neighbor. Third, assault has no bearing on relationship or not dimwit!! If the neighbor witnessed her doing the

I don’t deny that, I do know that police view these things on a case by case basis i.e 2 drunk guys pushing each other, etc. But an adult vs. 7 y.o. is a no brainer IMHO. The cop acknowledged what he did was wrong, why he chose not to charge him I can’t explain.

My understanding is that there is some leeway, maybe because she stated originally he was choked. But the fact he was only 7 at the minimum he gets booked IMHO.
