On the first play, sure. After that the PS4 loads the game just as quickly as the Wii U. It's really not an issue after that.

The packaging shifted and the system was marketed more as "PS3" than by it's full name. The US boxes clearly show that evolution.

The contents of the game itself are protected by COPYRIGHT law. It's TRADEMARK law that protects the names / logos. And if you actually get a mechanic that is truly unique enough to protect, I would imagine that patents would come into play at that point.

Did he actually start playing it or did he not realize he was just holding the controller and watching the demo play? No idea how you can get bored playing a Mario game.

The ones at Dave & Busters do take a card. It's actually a rechargeable "credit card" you fill with credits then you just swipe it at the machine you want to start playing.
