I don’t have an answer to this and I’m asking objectively: How do we adjudicate these cases?  There may be some lawyers among us who know a better way.

I believe that I’ve gotten your point. I think that you’re saying that the distance of missing the intended target is equal and is an honest mistake and that it should be treated the same way, which is what I’m disagreeing with.
