Maybe. From what I remember in English class, in the sentence “He made a connection with a guy that took his page down,” “he” would be (misgendered, it is the mom) referring to the victim, but “his” could be either “He” or “the guy”. (It’s a fairly textbook example of bad phrasing)

Regardless of any of that, the words “upon being awakened” are enough for this to be rape.

Minor point, but don’t you mean misgender her by using a photo of her presenting as a man? Maybe it’s my own confusion, but i’m under the impression “male” is sex, not “gender”. And in “PC” parlance the two are different things.
