To expound on the comment above, basically, under the Dram Shop law in NY there’s little wiggle room, it’s almost strict liability. If the bar served an obviously intoxicated person, and that person injures you, you can serve the bar. It’s mostly seen in DUI cases, but the law is not limited in that regard.

Bartender is responsible for guests. If guest gets over intoxicated bartender might be liable. Not sure to what extent liability reaches, but it could fall on to bar owner.

If the bar is found to have overserved the accuser to the point where she was incapacitated or unable to leave under her own power, I think they could be liable.
