I get that. I am just confused about the lawyer’s specific choice of words, as they appear to hurt the case rather than help it.

Maybe I’m the only one misinterpreting this. Later sources talk about how vacated roles were filled with younger, cheaper hires, and if that was the case with these employees I’d assume the lawyer would explicitly call it out as such because that’s a strong point in their favor.

I’d think the lawyer would/should specify if that was the case — to me, it reads like he was talking about existing employees.
