Culpability is culpability. Putting icing on that cake does not increase the amount of property damage done. Why should it increase the award beyond that of the actual damage done?

Yeah, I'm not a lawyer either. I guess that anyone could sue anyone for anything. I just think that this mentality sucks. Get compensated for the loss and move on. Shit happens...but none of us are owed anything more than covering a loss just because someone has shitty hiring practices.

FWIW, if you dig into the Miata forums, there are a few things that can be done for people of your stature to make those cars work for you (mainly, getting rid of the stock seat and bolting a low-profile racing seat to the floor). Nothing off of the dealer lot will work so well, though.
