I cannot imagine any universe in which I would grab a child BY THE NECK unless he was actually trying to murder me. That is inherently violent even if you’re not “choking” them per se. I bet the poor little guy was terrified.
If that child threw a paper ball at that officer he would have arrested that child for assault and battery on a police officer.
That’s what I was thinking. Choking or no choking, grabbing the kid is battery.
“Why don’t you teach your son not to litter?” Is not a civil question to ask of someone who just called the police to report that their seven-year-old was allegedly choked by someone who accused them of littering.
My friend was arrested for pushing her ex husband when he tried to take her car keys. Arrested 3 days later at work for simple assault. Her ex took one step back and that was all. I don’t see how this isn’t assault, he laid hands on someone with out permission. And it was someone without the ability to fight back.
Fuck you.
And the fucking cops admits that the dude put his hands on the kid TWICE, but essentially shrugs it off.

This totally got me. Grabbing a child is, in and of itself, assault under the most basic definition. This guy is a tool and needs to be disciplined heavily AND get a refresher on the law involved.
It’s a fucking shame that at best, this guy will only lose his job and not go to fucking prison where her belongs. Because, Texas.
