This is one of the things I do not understand about death penalty cases. We faced this is Boston recently, and I was astonished to find that the jury voted to subject the remaining Tsarnaev brother to the death penalty, over the objections of most of the surviving family members. It’s baffling.
I mean, they’re probably not wrong. The death penalty sure seems like cruel and unusual punishment to me and to a number of Supreme Court justices over the years, although the official word from on high is that capital punishment is permissible under the 5th Amendment.
This sounds like a drug-induced freak-out to me, not so much an entitlement problem. I don’t know the young man, maybe he’s also an entitled little shit, but it seems to me like what happened here had more to do with panic.
