That's true. But a lot of insurance doesn't cover different forms of BC anyway - even under the new law. So I'm not sure that it's much of a change in cost for most people. I have what's considered to be one of the best health insurance plan and they still don't cover a lot of non-generics of BC.

Prescriptions cost more because they usually require a doctors visit which can be expensive if you don't have insurance. Making it OTC makes it more available and affordable in general for women without insurance.

Yes, legal protections are a large reason why gay marriage is such a huge human rights issue here in the US. Hospitals can deny domestic partners from seeing their loved ones if the immediate family members don't want the girlfriend/boyfriend to visit. It's really fucked up.
