In the case that the jury can’t agree, the judge will declare a mistrial and then the prosecution decides if it’s cost-effective/politically necessary to try again.

I would advise against that, as a lawyer, because amazingly, people have been convicted for jury tampering for doing so, despite both the content of the pamphlets AND the conduct being legal.
