I've only had mine for a couple weeks but I have no problem with the speed of the menu loading. I power it on with the game pad and click my Mii, and by the time I've found the other remotes to turn on the TV and get to the right input, the menu is ready.
It's so gonna happen this year...
I don't follow the line of thinking that the output of the two consoles will be closer with time. Developers are going to learn the intricacies of both, while the limiting factor will forever be the hardware.

There's a good possibility that the market for the 3DS is already saturated. And Nintendo seemed to respond to this inevitability by releasing the 2DS. I wouldn't expect another 12+ million year of 3DS hardware sales. Software should justifiably be strong though.
