True, there are women who have killed their male partners or who they wish to have. Jodi Arias is an example. However, way more women are killed by men than the other way around. There are always exceptions to any “norm”.

They have to put a charge on him to hold him. They usually put the lowest charges at first, then the DA decides what they will prosecute for. Everything seems like a slam dunk until it goes before a jury.  But it does seem like murder 1 is a possibility. 

Odds are it will be, but this isn’t the charge he’ll be tried on. This is the charge he was *arrested* and on which he’s being held.  It’s important not to overshoot on the arresting charge, so you don’t risk going to trial with a heavier charge than you can prove, and risk an acquittal.

There is likely a parade of evidence leading directly to his door.  I doubt getting a conviction will be difficult.

He wasn't smart enough to change his clothes, so I'm willing to bet he either wasn't smart enough to wear gloves (especially while loading the gun--people forget that part) or he wasn't smart enough to get rid of them.
