@grok_this: There are very few forms of speech NOT protected by the First Amendment, and(judging from the info in the article) this one would most likely not satisfy either the libel or obscenity clauses. So yes, it is related to free speech and most likely protected by it, at least in the U.S. believe it or not.
@radarskiy: It IS as "new and special" as when humans went from spoken communication to recorded information. The interwebs have fundamentally changed the ways in which our society is capable of interacting and antique law isn't fully capable of dealing with it.
The sentence wasn't strictly for the posting of nudie pics, he was also convicted of 6 other charges incl. death threats and theft.
