Castor claims his decision was because he was sure he couldn’t get a conviction based on the evidence, so a non-prosecution agreement allowed a civil trial to go forward and force Cosby to testify. Given that his decision was pre Me-Too, he might have been right about that.

Bruce Castor was acting as a DA at the time; his agreements are enforceable. But for that agreement, Cosby wouldn’t have testified at the civil trial. Nobody is disputing the existence of the agreement. 

The laws and rules regarding being applied here are MONUMENTALLY important and absolutely a good thing. Cosby is a monster. Both those things can be true.
