I think courts would certainly be open to reevaluating the application of “baseball rule” if the league recommends new safety standards. Especially if the majority of ball parks end up implementing new standards and someone gets hurt at one of the outliers.

I think ethics are at the root of this move by congress. Cutting the purse strings is just the easiest way for them to put the kibosh on it.

Nobody is saying it’s wrong for the NFL to charge for it. They’re saying it’s a waste of money for the DoD to pay for it.
