Basically every state has an independent government body charged with upholding state anti-discrimination laws. That authority is granted by the state legislature. This is not fishy in the slightest. It is par for the course in anti-discrimination law, which exists at both the federal and state level.
For any who think this is a First Amendment issue:
Operating a business in the public sphere means you agree to comply with anti-discrimination laws. Nobody forced the business owners to do that.
They already tried that, but it was shut down because you can't use gofundme for things that are against the law. They were trying to raise money to pay fees and for the judgement, and since they broke Oregon law, it was shut down quick.
The agency is likely setting an example. If it was only a few grand, how will other businesses be deterred from engaging in the same type of behavior?
