It is not illegal to pass on the right in California. Also, in urban settings, it’s quite common for people to pass on the right - using the left lane for passing is for highways, not urban settings, since people often make left turns, slowing traffic.

Passing on the right is neither illegal or uncommon in my state.

It is ironic that personal injury litigation might be the one major hurdle to autonomous tech which has the potential to save thousands of lives each year.

IMO this is why autonomous tech won’t reach the masses in my lifetime. Too many lawyers anxious to file suit against the ‘deep’ pockets of the automakers will lead to driver assist over autonomous even when the opportunity for truly self driving is a reality...

Astronauts get pulled and reassigned all the time. (Ever seen Apollo 13?) Until details come out there’s no way to know if race played into this.
