You're right, although my point was less about specific companies, and more about size/portfolio of companies.
The point i'm bringing up is that they WOULD be able to circumvent these rules, whereas Adult Swim cannot, even though, in my mind, it is a notable brand as far as game publishing goes (just not in this context.)
I understand their reasoning, but they clearly would not have done this had the publisher been EA or Activision. What a messy situation—hope it works out for all parties.
