Everybody agrees that rape is a very serious crime, but not everyone shares the same definition of “rape.” Those who believe we live in a “rape culture” hold that a lot of sexual behavior that is normalized and accepted by society is actually rape.
What’s your basis for claiming “obviously there was evidence offered in her favor which overwhelmed this flimsy garbage”? The fact that the University panel ruled against him? Is that it?
Or, like in most of these cases, women lie or simply regret doing what they did. See Rolling stone, Duke Lacrosse, Patrick Kane, most nights on a college campus...
Why is scrutinizing her behavior before and after the incident a “stereotype.” We have no witnesses and no evidence to what went on when they were alone in the room, so we have to assess the situation in light of mutually agreed upon facts, or facts that can be substantiated by other witnesses and evidence.
It sounds like this could be our “affirmative consent” case, where the surrounding circumstances offer no indication that sex was nonconsensual, but the accused failed to make an affirmative showing of consent.

When it comes to sex, women hold ALL the cards. Look at the Duke Lacrosse case, or the UVA Rolling Stone story, or the Patrick Kane case, or the Brian Banks case. The list goes on and on and on. I know people around here think false rape accusations are few and far between, but that just isn't true whatsoever.
anytime the charge is rape, everyone on these message boards becomes nancy grace. guilty until proven innocent.
Let me ask you a question: in a court of law, without any other evidence regarding someone’s guilt, and in a case of he said, she said, do you believe that communication between the accused and the accuser should be irrelevant? If you do, we’re simply not going to agree.
I don’t doubt that, but most people commenting here would convict on a woman’s word alone, so that doesn’t hold a lot of weight to me.
If you feel like Yale expelling him proves that he raped her - great. The entire point of his suit is that this wasn’t the case. He could very well be wrong, but no one here knows that.
She wasn’t sufficiently traumatized to abstain from sex with him for 24 hours.
I never said it was that uncommon, only that lacking any other evidence outside of he said, she said, it’s evidence in his favor. That seems nearly impossible to dispute.
If this is what happened then the actions of the school are bogus.
