FYI, the problem wasn’t that the background check didn’t reveal his arrest, but that there was confusion regarding the jurisdiction of that arrest, and while the background checker sought to figure it out, the 3 day waiting period expired. So this isn’t a glitch or clerk mistake, it’s a loophole in the law.
