The story I heard last night was that he was walking along the tracks and the train clipped him. Not that he was crossing the tracks. This happens all the time in that area because the tracks are across the street from a school and there is no fence or any barrier along the tracks.

@Sigismond0: Not anytime soon, not only is it a violation of the NDA you cannot install it with iTunes. You have to have your UDID submitted to Apple and restore your iOS device using Xcode with the 4.2 SDK.
