Under Title IX, the accused and accuser have the same rights to inspect evidence, outside counsel, etc. And, if you are accused and then treated unfairly, you have recourse in the form of the courts.
If you force someone out of a class because they were accused of rape, they are going to sue you. If you haven’t had a hearing to determine if that removal was appropriate, they are going to win. Simple as that.
