There is also the consideration that the presumption of innocence on the part of the accused does not imply that the accuser is a liar. That is a false correlation.

In all honesty, why should he? You assume Kesha’s story is true but he believes an entirely different set of facts and thinks she’s trying to destroy his reputation and cost him lots of money. You and I might agree with Kesha but he certainly doesn’t.

That system can be described many ways, but “paternalistic” it is not. It assumes that every individual is capable of being his (or her) own advocate.

That's the issue the judge was asked to adjudicate. This isn't a sexual assault case. It's a contract dispute. If and when the allegations are proven in court, the issue could and should be heard again. Until then, you can't invalidate the contract because of an accusation. That's a very slippery slope.
