If there’s no post-close rental agreement in place and the property is still occupied when you do your pre-closing inspection, your realtor should absolutely have advised you to not close until the situation is cleared up. I’m wondering if they’re researching whether they can deny the buyback because of title fraud. He’s totaled the car and put it into salvage title condition— he probably should have reported it to his state’s DMV and gotten a salvage title. Which would have made it ineligible for buyback.

Do you have a source for that? Generally if a corporation is set up correctly getting at officers’ assets in bankruptcy is really hard. The corporate veil can be pierced in certain cases but you’re definitely going to have to lawyer up. The corporate officers & BOD being idiots and running out of money won’t do it.

One tweak to your order; the collatoralized loans are only on top with respect to the specific collateral asset; at least in the US owed wages are the top priority for liquid assets, then unsecured debt & accounts payable; then (if not public) preferred equity, then common stock.
