Law enforcement and prosecutors are distinct entities.

If we’re getting nit-picky here, law enforcement doesn’t “press charges.” They investigate, and a prosecutor makes the charging decision.

It was either a search warrant or something akin to it. It’s used to gather evidence of a crime. The blood alcohol is evidence of DUI. And when you get your license, you have consented to having your blood, breath, or urine tested when you’re arrested for DUI. Pretty standard practice.
