Believe me, it was no joke, it was a bitch move, a bitch move fueled by anger. Tony is an emotional mess, he may have good intentions but he does not have enough emotional control to be a hero on the level of Cap.
And that's why I'm glad that the final conflict in the film is based on something far more personal and so far more satisfying.
