The union should also protect the worker in non-economic ways, like safe working conditions and preventing the employer from "requiring" overtime, protecting workers who need to take sick time, enforcing vacation rules and others. I'm pretty sure the max contract has way more to do with denying a player his true market value than the existence of a union. Baseball and football starts seem to get their market value just fine.

Disagree. Business has suffered and eventually collapsed in every example we have for replacement players. The NFL twice (second time with XFL), MLB and NBA. It takes a generation to find a Lebron, it takes an auction to find the next NBA owner.
