Driving on public roads requires a license from the controlling body, or it's authorized to punish you in accordance to the law. You have a right to do what you will with a car on your own property, but as a common good, the vast majority of roads require you abide by the laws in order to make use of them.

Technically, yes! A patent is supposed to be a limited, specific government-sanctioned monopoly to encourage development by preventing others from profiting off of your idea. Now, I can't begin to get into whether current design patents are overly broad and breech the realm of what patents SHOULD be doing, but yes.
