She was there as a result of fleeing the police. In the eyes of the law that makes her responsible for felony murder. I can't help that you don't understand the concept, but that doesn't make it any less true.

Even if they did, she was a party in a whole slew of federal felonies, including bank robbery, etc. The chances they'd give her time served for that are pretty slim to none since she broke out of prison and fled, which carries an additional sentence.
