Easy solution to having the TSA agent guess at gender (beyond just getting rid of the TSA entirely): set up two scanners and have two lines and let the passenger choose which gender they most closely identify with.

The TSA agent has to decide (maybe 5k times a day, if not way more?) gender as a scan requirement, you say? What a crazy job duty for $15/hr and a GED.  Not to mention the potential to mess w/a co-worker you don’t like, “just for fun”, to make them do more pat-downs, as just one example of how dumb this is.

The pat down is bad enough - a strip search is inexcusable.

Court reform!!! Seriously that is our only option. I saw this as a civil rights litigator. We are doomed otherwise. If you are uncomfortable with the idea of expanding the court, there are other court reform proposals out there, like rotating term limits that would allow each presidency to get justices on the court.
