Most DNA is gathered without a warrant, from crime scenes. It’s relatively easy to gather from clothes, dishes, utensils, whatever. Then you tie that evidence to a person... All without a warrant. Then you take that evidence to a judge to get a warrant, to gather DNA straight from the source.

And that’s exactly where your argument falls apart. They must get a warrant to get a sample directly from your body, or they must follow the chain of evidence and witness you leave it somewhere that they can then test for it.

It’s not though. Not even remotely close to being the same. DNA evidence is typically left at a crime scene. It’s outside of your body. Data from an implantable device is still inside your body. Your body must be manipulated in a way to gather that evidence.

Device data that contains PHI would thus be covered under HIPAA. At no point in time is identifiable patient data owned by the manufacturer or the vendor.

Most victims of abuse go on to become abusers. There’s a pretty strong cause and effect linkage there.
