Yes, I got all that - however he wasn’t charged with / on trial for “choking,” and I don’t see how a restaurant would be criminally liable for someone choking on their food. Exactly what would a restaurant be charged with as a result of such an incident? I doubt it would be felony assault.

I think the OP’s point is that once you “touch it” (i.e., eat some and pack the rest up to take home), it’s yours - and has nothing to do with the restaurant’s side of the issue. The preceding sentences are important context.

Better yet; if you no longer want a dish because it is late, tell the server that when they show up with it (if not before) rather than accepting delivery of it.

Eh - a diner choking on their food isn’t exactly analogous to someone being raped. I don’t really see how a restaurant would be at fault in such a situation - or what charges would be brought against it, either. A bit of a fail, if you ask me.
