True, but it takes effort to develop a physical dependency. Almost everybody drinks, and even most heavy drinkers don't develop a true addiction. Psychological addiction is another story, but you can't really regulate that.

Those aren't physically addictive in the same sense that cigarettes are.

I disagree that Apple is making "the same sort of decisions" as MS with Win8. What they're doing in terms of iOS/OS X convergence is creating desktop-oriented mirrors of the features in iOS (a.k.a, the right way to do it), whereas MS just decided to make ONE OS TO RULE THEM ALL. They already did earlier this year. This judge seems to think that this is a matter of first impression because the word GPS wasn't used. Cell triangulation and GPS tracking are effectively the same thing in terms of law enforcement use. This will almost certainly be overturned in a higher court.

The Supreme Court already smacked down the FBI for warrantless GPS use. How is this case different?

What I'd like to see is them cut a deal with a cable provider to allow you to use either their cable box or an AppleTV cable box. This doesn't sound like what it's going to be though.
