He admitted to a 7 page factual basis laying out in extreme detail how he drugged a bunch of women before raping them. He cannot contradict any of that if he goes to trial.

You would think so, but no. Read the second exception. That guilty plea was given under oath and as part of the guilty plea, he affirmed the veracity of the factual basis.

This isn’t the best case to make that point on. The judge knows at least what is in the PSR, which out to be fairly detailed, and also what is in whatever sentencing memos the parties may have submitted.

I believe the federal rules of evidence render any statements made during plea discussions inadmissible, which this document would probably fall under.

That’ll be inadmissible under FRE 408 as part of plea negotiations.

Violent offense versus non violent offense. Hard to compare the two as equal things ethically.
