Tenure isn't really a great incentive for capable people. You only need tenure if you plan on sucking at your job in the future.

Just because the car isn't in the parking lot doesn't mean work isn't being done. From what I've seen, taking work home (grading, planning lectures/curriculum) is standard practice for teachers. And really, time off for the summer is only going to attract lazy people, not ambitious and capable people.
